The following described the terms on which checkcomposer.com (a service provided
by Paradigm Information Solutions, Inc) offers you access to our services.
OWNERSHIP OF SERVICE
CheckComposer.com is a service which is provided by and owned by Paradigm Information
Solutions, Inc.
DEFINITION OF ROLES
Roles in the system will be defined as follows. The Registered User (User) is the
person who setups up and uses the checkcomposer.com system. The user is the payee
on drafted checks. The client is the users client or customer; this is the person
who will be the payer on the check.
DESCRIPTION OF SERVICE
Checkcomposer.com is a check printing service which allows its users to print duplicate
check drafts. The user is responsible for inputting and maintaining data required
to print checks. The user is required to obtain documented permission from their
clients before printing checks and drafting the clients account
PRICING
Please refer to the 'Pricing' section to view current CheckComposer.com fees.
We reserve the right to modify the pricing schedule at any time. You will be notified
if the pricing schedule changes.
REFUNDS
We offer a 30 day money back guarantee. If you sign up for our service and
decide that it is not suitable for your business we will refund your remaining
balance. Refunds after the 30 day window will be granted solely at our
descretion.
CHECK PRINTING
You agree to inspect all printed checks for errors or omissions which may have occurred
during the creation or printing process.
NO WARRANTY
WE, OUR SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES AND OUR SUPPLIERS PROVIDE OUR
CHECKCOMPOSER.COM AND SERVICES "AS IS" AND WITHOUT ANY WARRANTY OR CONDITION, EXPRESS,
IMPLIED OR STATUTORY. WE, OUR SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES AND OUR
SUPPLIERS SPECIFICALLY DISCLAIM ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY,
FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. Some states do not allow
the disclaimer of implied warranties, so the foregoing disclaimer may not apply
to you. This warranty gives you specific legal rights and you may also have other
legal rights that vary from state to state.
LIABILITY LIMIT
IN NO EVENT SHALL WE, OUR SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES OR OUR SUPPLIERS
BE LIABLE FOR LOST PROFITS OR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING
OUT OF OR IN CONNECTION WITH OUR SITE, OUR SERVICES OR THIS AGREEMENT (HOWEVER ARISING,
INCLUDING NEGLIGENCE).
INDEMNITY
You agree to indemnify and hold us and (as applicable) our parent, subsidiaries,
affiliates, officers, directors, agents, and employees, harmless from any claim
or demand, including reasonable attorneys' fees, made by any third party due to
or arising out of your breach of this Agreement or the documents it incorporates
by reference, or your violation of any law or the rights of a third party.
LEGAL COMPLIANCE
You shall comply with all applicable domestic and international laws, statutes,
ordinances and regulations regarding your use of our service. You agree only to
create checks which your client has granted permission for you to create. You agree
to create checks only for legitimate business transactions.
FRAUDULENT USE
We do not guarentee, verify or investigate transactions performed by users of checkcomposer.com.
